Your Travel Secret and Homeschool Travel Resource

Business Owner: Shanda Smith, d/b/a Your Travel Secret and Homeschool Travel Resource (“Advisor,” “we,” “us,” or “our”)
Client: The individual or entity requesting or receiving services (“Client” or “you”)

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Client and Advisor. Client’s request for services, execution of any agreement, or authorization of payment constitutes knowing, voluntary, binding, and informed acceptance of these Terms. Advisor may update or revive the terms from time to time in Advisors sole discretion. 

1. Advisor Role; Advisor, Agent, and Concierge Capacity

Advisor operates as a travel advisor, booking agent, and travel concierge, providing professional travel planning assistance, recommendations, coordination, and booking services.

Advisor:

  • Acts as an agent for disclosed third-party travel suppliers;
  • May provide concierge-style coordination and logistical assistance; or
  • Does not act as a tour operator, carrier, insurer, guarantor, or fiduciary.

No special duty, fiduciary obligation, or heightened standard of care is assumed or implied by your acceptance of these Terms of any service provided by Advisor.

2. Third-Party Supplier Responsibility

All fullfillment of any travel plans, contracts, or tickets for passage are provided by independent third-party suppliers (“Suppliers”).

Advisor does not own, operate, manage, or control any Supplier and expressly disclaims liability for:

  • Supplier acts, errors, omissions, negligence, or misconduct;
  • Supplier insolvency or financial failure; or
  • Changes to itineraries, pricing, schedules, or availability.

Client agrees that Advisor has no duty to investigate or monitor Supplier solvency, safety, or regulatory compliance.

3. Assumption of Travel Risk

Client acknowledges that travel involves inherent and potentially unavoidable unpredictable risks, including but not limited to illness, injury, crime, pandemics, weather events, government actions, border closures, or force majeure events.

Client knowingly and voluntarily assumes all risks associated with travel and the services provided by Advisor, whether known or unknown, foreseeable or unforeseeable.

4. No Warranties or Guarantees

Advisor makes no warranties, promises, or guarantees, express or implied, regarding:

  • Safety, security, health, cancellations, postponements, change, or legal conditions during your travels;
  • Quality, suitability, or performance of travel services;
  • Entry into any country or jurisdiction; or
  • Any third party action or inaction described in section 2. 

All advice is advisory only and not a guarantee of outcomes.

5. Client Responsibility for Travel Documents

Client is solely and exclusively responsible for obtaining, maintaining, and carrying all required travel documentation, including but not limited to:

  • Passports
  • Visas
  • Government-issued identification
  • Health records, permits, authorizations, or entry documentation

Advisor does not verify documentation and shall not be liable for denied boarding, entry refusal, delays, fines, penalties, or losses arising from improper or missing documentation.

6. Duty to Review Documents

Client must review all confirmations, itineraries, invoices, and travel documents immediately upon receipt.

Failure to report errors within 24 hours constitutes acceptance and waiver of all claims.

7. Lawful Conduct and Prohibited Activities

Client agrees to comply with all applicable local, state, federal, and international laws during travel.

Advisor expressly advises Client:

  • Not to purchase, possess, transport, or use prohibited, banned, or illicit items
  • Not to engage in unlawful, unsafe, or regulated activities

Advisor has no duty to monitor Client conduct during client’s travel and shall not be liable for consequences arising from Client’s unlawful actions.

8. Travel Insurance / Travel Protection Disclosure

Advisor strongly recommends the purchase of travel insurance, also referred to as travel protection, which may include coverage for trip cancellation, interruption, medical expenses, evacuation, and supplier default.

If Client  declines to purchase travel insurance or travel protection, Client expressly assumes full financial responsibility for losses that would otherwise be covered thereby and the risk of bodily injury during your travel.

9. Fees, Memberships, and Compensation

Advisor may earn commissions from suppliers and Advisor may charge upfront professional service or membership fees, including for non-commissionable travel.

All fees are earned upon consultation or booking and are non-refundable unless expressly stated otherwise in writing.

10. Cancellations, Changes, and Refunds

All cancellations, changes, and refunds are governed exclusively by Supplier terms and policies.

Advisor has no authority to override Supplier terms or policies and makes no guarantees regarding refunds.

Advisor strongly advises Client to carefully read all applicable supplier terms or policies. 

11. Credit Card Authorization; Third-Party Processing

Client authorizes Advisor to process credit card charges for approved travel-related transactions and professional fees.

Client acknowledges and agrees that:

  • Credit card information may be collected, stored, and processed through Tern, a third-party travel management and workflow platform
  • Tern operates independently and is subject to its own terms and conditions, available at tern.travel
  • Advisor does not control Tern’s systems, data handling, or security practices

Client agrees that use of Tern constitutes acceptance of Tern’s terms and conditions.

12. Timeliness of Credit Card Authorization

Client agrees that timely credit card authorization is essential to secure travel arrangements.

If credit card authorization is not received promptly:

  • Pricing, availability, and reservations may change or be lost
  • Supplier penalties or rebooking fees may apply

Advisor shall not be liable for losses, increased costs, missed opportunities, cancellation, or fees resulting from delayed, incomplete, or rejected credit card authorization.

13. Chargebacks and Disputed Transactions

Client agrees not to initiate chargebacks for authorized transactions.

Chargebacks related to Supplier performance, dissatisfaction, or enforcement of disclosed policies constitute a breach of these Terms.

Client shall be responsible for all chargeback-related costs, fees, penalties, and administrative expenses incurred by Advisor.

14. Limitation of Liability

To the fullest extent permitted under Alabama law, Advisor’s total aggregate liability for any claim shall not exceed the total commissions and professional service or membership fees actually received by Advisor for the transaction giving rise or otherwise relating to the claim.

Advisor shall not be liable for indirect, incidental, consequential, emotional, or punitive damages.

15. Indemnification

Client agrees to defend, indemnify, and hold harmless Advisor from any claims, damages, judgements, losses, or expenses arising from or relating to:

  • Client’s breach of these Terms
  • Client’s unlawful conduct during travel 
  • Acts or omissions of Suppliers
  • Improper or delayed credit card authorization

16. Force Majeure

Advisor shall not be liable for delays, cancellations, or failures caused by events beyond Advisor’s control, including pandemics, weather, government actions, labor disputes, Acts of God or Supplier defaults.

17. Governing Law and Venue

These Terms shall be governed exclusively by the laws of the State of Alabama.

Any dispute shall be brought solely in a court of competent jurisdiction located in Alabama.

18. Acceptance

Client’s payment, execution of a client agreement, or credit card authorization constitutes knowing, voluntary, binding, and informed acceptance of these Terms.
